I would have done that but for 2 things.
1) the car has a loan on it, and the check would of been made out to the loan instituation before me.
2) the damage was so great that I wasn't sure what to expect, the original estimate was $5200, now the 'bill' is just at $7000 and still climbing.

Damn that sucks.. That doesn't leave you with much to do... Hopfully you will get everything figured.
