So, I'm hitting foam golf balls in my court yard like I have been doing the last two days, when I notice the "handy man" from our apartment building power walking towards me.

I think to my self, OK, I guess he is gonna tell me to leave... no big deal. Nope, he starts just being a dick and a half to me right off the bat and normally I would consider him very nice too so this caught me off guard... To keep it short we exchange a few words and he tells me I'm a smart ass. So I say, "It's better to be a smart ass than a dumb ass."

Now he gets nose to nose with me and is about to hit me in the face. I'm like, "Are you really going to hit me in the middle of the court yard?" I bend over pick up my foam golf ball and he kicks me in my arm with his cowboy boot hard and leaves a pretty damn noticeable mark almost looks like a bee sting and drew a little blood.

I start to try and walk away and he keeps following me trying to intimidate me physically since he is a much larger man than I. So, I give him several warnings to leave me alone or I'm calling 911. He doesn't leave me alone so I call 911 because I really thought this guy was going to try and fight me. As I'm calling 911 he still is trying to follow me around and threaten me saying it will be my word versus his word and since I'm young they will never believe me.

So 911 sends an officer out and the first thing the officer tells me when he sees me is, "Ugh, I shouldn't even have to be here right now." I give the cop my side of the story and he goes and gets the "handy mans" side of the story. Cop comes out saying our stories are conflicting and nothing is going to happen. He ask me if I would like a police report, I respond with a yes. He then proceeds to try and talk me out of it several times suggesting that nothing will happen. More like his lazy ass doesn't want to have to do paper work. I did end up doing a police report and we'll see where it goes from there I guess.

The reason this upsets me is because if it were to be on the other foot, young man who kicks the older handy man, I would have been arrested on the spot! Nope, since he is old and I'm young my word and injuries mean nothing. I bet this guy doesn't get fired or disciplined by his employer. If anything happens from all of this it will be me getting evicted from my apartment complex for some bullshit reason.

Did you file a report with your apt management company? Did you take pictures of your injury? Any witnesses?

Most cops are lazy and worthless so I feel your pain there.

Not yet, this just happened Kracka, however that was something I wanted to do because I know that the apartment manager will do nothing about it.

I personally haven't taken any pictures although I should, the officer did take about 4 different pictures of my injury. There possibly was a witness but I'm not sure if he could see what happened from the angle he was at.

The funny part about witnesses is that the cop kept saying there was no witnesses so just give it up. I said there could of been I know the apartment he would of been in if he would of seen it. He responds to me with, well I don't see him out here so I don't care.

Yes, I was able to keep my cool and stay level headed. Which I am very thankful of, because if I would of reacted the way I normally might have, I would probably be sitting in jail and not sitting in my apartment on the internet while watching ESPN.

He said I took a divit (sp?), that was what got him upset to begin with. Then when he was walking away he called me a smart ass for reasons I'm still trying to figure out. I of course replied with my usual, it's better to be a smart ass than a dumb ass line.

That's when he came charging back at me and got up in my face. I probably shouldn't have said that, but I'm not going to lie I was upset that he handled the situation so poorly.

All he had to tell me was, you know what man? I don't think there is a rule to prevent you from hitting foam golf balls out here but I would appreciate it if you didn't. I would of been like sure no problem, I will go to the park that is a mile down the road and the whole situation would of been done.

Just got off the phone with the apartment management company lake Kracka and others suggested. They are willing to let me out of my lease, which I wasn't going for, however it would be extremely helpful and save me money. Especially considering I want to go back to college at Lake Superior Community College for Fall semester.

Now I won't have to pay rent at two places!

Actually you sound like the sort of cool-headed person that would do okay with a carry permit. Fun to joke about being Dirty Harry but in the real world there are no second chances when a gun is in the mix. I personally don't carry much because I like beer.

Just so everyone knows, problems can be solved without brandishing or firing a gun. To really "get" the guy, all you'd have to do is put a bunch of divots in front of his place during the night, preferably after you move out though.

Yeah, I'm a big fan of carry permits, but this isn't that type of situation. Brandishing a gun isn't any better than hitting the guy with a golf club, it can still be a felony either way. (assault vs terroristic threats)
