how about NO we don't do that, what we need to do is
go look around and find who's wifi is unsecure and then inform them of it....

And then tell them we know a guy who can make it secure (www.unix-networking.com) for you for a small charge of $$$$....

however there is a dilema, they can already blame you for a break in if you leave any information for them.. i will have to read up on those laws a bit, or maybe Mike can elaborate a bit more

It is fun, but I figured out that as much of a problem as it is, some of these places view you as a hacker that has made some malicious move on there network no matter how you present the security flaw to them. They usually claim they will have someone internally fix it, then they don't do a thing about it. I have seen it over and over again. In fact, a rather large grocery chain locally (biggest you can think of) is wide open on many of it's stores, DHCP running, broadcasting the BSSID, no authentication etc. Any kid with a wireless card and laptop can play on their networks while their mom is in shopping. Was the head security guy in shock? Of course. Did he say he would fix it? Yep and 2 years later, it is still the same.

It stopped being amazing to me after I figured out that no security is the norm and no one seems to care even if you tell them. So rather, I just consider them useful internet connections when I am away from my own.

On that note, somebody buy my Libretto Think of all the fun you could be having!

Oh and on the note of legality, it is illegal to intentionally access and utilize any network that you don't have permission to use. You can do the smart thing and mask your MAC address, and not be too obvious about it and they would never know or be able to track you. The main thing is that since the towers were attacked on 911, hacking itself has been upgraded to a terroristic crime by the Feds. Not a good thing to be caught doing. Of course my Cisco card tells everyone it is 3com when I am exploring for just that reason. One last note, just identifying open networks is not illegal since it is a passive activity and the packets are being broadcast to the public as well, it is what you do with the network that can get you nailed.

okay so this has happened to me before. I am cruising around with my laptop plugged in to the radio listening to tunes through my laptop cd player. I will be at a stoplight in a business area etc. Then my msn just logs in, so if I use it there that is illegal or what?

If we got every business to get big wireless we could just drive around always, wirelessly on the internet! That would be nice, but I have stopped in a parking lot before when discovering open wireless and checked my emails, it is a chance to let the engine cool down.

It is unfortunately illegal to make use of the network if it is not advertized for public use, even if it finds you There are a lot of places that do have public networks though like coffee houses etc. The thing is, I don't think you would really have any issue ever as long as you are not being malicious and just using it as a connection etc. Any admin with that much interest in protecting there network would attenuate it properly and protect it with some security to begin with. If they aren't doing that, there is not much chance they are interested in logging your packets to figure out who you are to prosecute you.

On the project idea, there are several cities already doing this. Check Seattle Wireless
