Your right there might be some questions to answer but like I said before, if you kicked and assaulted a police officer or a armored car driver they would draw their weapon on your in a second, and their carry permit is the same as a civilians as far as I know.
In this specific case he got kicked while down and the guy was a lot bigger than him, and I think he was chasing or walking after him, I think the threat was there and it could have gotten a lot worse.
But your right anytime your pull your weapon you better be ready to answer a million questions as to why.
