What Would You Do?
Just recently (Sat) I traded the blue Auto GSX for a 91 Talon TSi, He needed a car that he could drive..
I ended up meeting him at his house earlier that day so we could check out each others cars. He drove mine around a couple blocks and when he got on to a main road asked me if he could rip on it.. I said sure but if we get pulled over its his ticket. We end up getting back to his house and he said he liked it i explained what it needed and what was good and he seemed set on it. I drive his around a couple blocks and get back to his house and he said he would call me on tuesday. He calls me a couple hours later and asked me if i wanted to do it that night and said yea.
So he limped the talon over to my house where we swap wheels and the steering wheel and do the paperwork. He didnt have the title yet and i was fine with that so i typed up some bills of sale and told him that when he gets his title we will just swap.
He ends up calling me today and tells me that the tranny is shot. Wont go into any gear and doesnt know why, He said that he drove it "Normally" and only about 10 miles...
Now heres the thing, I,ve put a little over 1300 miles on that car in the 2 months i owned it and never had any tranny issues. Never slipped, Never any funny noises, shifted nice and strong!
So basically what he wants is to trade cars back and he is saying that he'll do anything. I dont need a broken car, When it left my driveway it ran and drove fine and how am i supposta believe him when i was with him and he beat on it.
Im pretty frustrated over the situation, But what would you guys do?
I have a signed bill of sale and a copy of the title when he transfered it into his name. I still have my title for the GSX and id assume he would want that even if the car is now broken.

YOu have a signed bill of sale. Too bad for him. Sold as is. Just say no. The car was running fine when it left and you accepted it as is. Sucks but its a dsm. Im sure there are some stories around here of a car having a problem on the drive home. Shit happens.
But when he says he wants to rip on it on the test drive that should be enough evidence of the trauma it has been through since the sale.
If he wants to go to court for it, do it, bill of sale means its sold.

I agree. Similar thing happened to me when I sold my laser. Guy came to get it (I didnt have a title, was being overnighted to me) and we both signed a bill of sale. Only reason I couldnt wait a day, was because I was coming home that weekend to buy my other car and needed the money. The laser ran good, the turbo was crap (told him that) and I had the boost low so I could save up and buy a new one. I guess the guy cranked the mbc before he left drove it 2 blocks and called me cause it was smoking bad. Turbo blew up, shot oil all the way down the exhaust, and the guy was pissed at me. I ended up grabbing a turbo from my buddy and swapping it out for him. It sucks when crap like this happens, made me feel bad, cant imagine being in your shoes. But the other guy is s.o.l. Maybe he will learn to be nice to dsm's, they bite back...haha.

Exactly. And im not worried about him bringing me to court, If anything i will be bringing him to court unless he gives me the title. I have AS-IS written in the bill of sale as well.
I do feel kind of bad but i don't think im in the wrong.

Yep if you beat on them be prepared to fix something, When i was with him we stopped at a light he put it down into first and ripped it to 6500 let off putting it into second and then smashed it again while the tranny was shifting between gears!?!?!?! I didnt say anything at the time but he has to know im gonna bring that up.

I wouldn't worry about it; especially with these cars, who the hell knows what he did when he left. He could have been brake boosting the shit out of it and destroyed the end clutches or something. If he were lucky maybe the TCU went out on it but who knows.
Next time you talk to him ask him if he would have done the same thing if you would have broken a shift fork after the deal was final. If it was something that might have been overlooked by you that he should have known before hand then I would say help him out otherwise no way.

That sucks but im with everyone else. Hopefully you can get the title for his car without too much trouble.
I would never actually trade the cars till the title is in his hands and ready to sign over. Too many bad things can happen if you let the other person hold on to the title, etc.

When I sold my black gsx a coolant hose broke in the first 30 miles, I helped the guy diagnose and fix it but I'm sure it's not because he was ripping on it. In this case, given his test drive, I wouldn't do much to help him out. Maybe help him diagnose what exactly broke, but that's it.

Yeah, with that kind of test drive I can only imagine its his fault he blew the auto. From what Ive learned about them, they arent the best in the world for doing that kind of crap. Sucks to be that dude.

Used car, sold as is, end of story. You can help him figure out whats wrong if you want to spend your time doing that, but do not feel like you have to. I have an auto tranny I could sell him if thats the problem.

Whats funny is the other day when i talked to him he said he drove it home "Normally" But he left me a message the same night saying that he did boost it but only a few times...

Ha.. Dont say that! This car is actually really nice it has a major fuel issue though. But if that does happen he included an extra shortblock that looks to be in really good condition!

Well im holding the title for his car and i have signed bills of sale stating that i will have the title by the 20th of Feb, If he doesnt deliver i will have to bring him to court. He doesnt seem to be that type of person and i've been super reasonable with him and he seems to appreciate it. Im just trying to be fair with him and get the situation figured out so were both happy. He doesnt want anything to do with court either, I kinda brought that up and he says that he will give me the title he is just bummed out.

It is for sure the problem, He says that it doesnt go into any gear! Doesnt Move! I just dont understand how he could have done that. He had to have been beating the shit out of it.
You should PM me some info on that tranny and a price. Also i will be calling u very soon for those parts
Once again thanks for all the advice. I hope that everything works out and in the end were both happy.

Maybe he doesn't know how to drive a stick, and blew up the clutch disk? I am always pretty nice with these things. I would try to hook him up with used parts or something if I could, but in the end he bought it. The rough part is that you still have to deal with him for the title for your car.

Yep it was an auto.. I got a 91 Talon TSi, pretty damn clean. There are a couple problems with it but i felt like i got a good deal.

Nice! Auto or manual. If youre at all intrested in selling it (if everything works out), I will be looking to pick up a 1g by the end of next month. And thats exactly the color scheme I've been looking for.

Its a manual, And in very good condition inside and out. It will have many new parts in it before i sell it.
