Legal Help
My work has fucked me over. In the last 2 weeks I worked a total of 78.xx hours and the 2nd week I woked 44.14 hrs(overtime). My work doesnt like to pay over time so what did they do? They deleted 4.14 hrs off of my check so my check says I worked 74.xx hours. There has to be a law agenst this. Does anyone know where I can find info on this to back me up and show them Im not playing around. Its only 4 hrs but Im not the first people they have done this to and I wan my manager fired(cuz she sucks).

Report this to the MN Dept. of Labor.

You can call, go in, or just send them an email and they'll tell you what steps need to be taken, and if necessary, will step in and contact the employer directly. Your hours can not be cut or moved to the next week, that is illegal. You must be payed for the hours you worked when you worked them.

I have been screwed by bosses who try to manipulate either the hours worked or how they record them. I just quit, but if you have proof that they indeed screwed you, you have to do something about it.

Did you talk to them about it? No, that is not legal, especially if you are paid hourly. I'd tell them to them to give you your money or you'll be taking legal action. And don't let them get away with 'making it up to you on your next check' or anything bogus like that.

Alright I talked with the MN dept of labor and they told me I should talk to my work first and if they dont do something call the Us dept of labor because this is a federal case because they took out my overtime.
Then I went to my work and talked to the GM of the store(byerlys) and he made copies of my time slips and check and is "taking care of it". He said that it should be on my next check. Is that OK? from the sound of it Chris you think thats not enough.

And also at my work if you work 20hrs a week or more then each holiday you get 4hrs added to your check. Well I work 2 different positions, a cook and a server. And on that holiday(labor day?) I worked as a cook($10.30) and I got 4 hrs of holiday at $6.15(server pay). So I complained to them about that too cuz I think that bullshit. I mean thats what $20 extra its not like im going to die its just the thought of them not getting this right that pisses me off the most.

Ideally you should be able to get a separate check issued to you for this, but if you aren't trying to cause too much turbulence and they actually get the correct amount of money to you on the next check I'd just let it be.

Just stay on top of it. If you don't get reimbursed for the missing pay go speak to the GM again and contact the department of labor.

a lot of companies (not nessesarily yours) will pay for Approved overtime only. So if its not approved then your out of luck.

According to the law they have to pay me overtime if I work over 40 hrs. Approved or not I worked and I want at least get paid for the 4hrs at regular pay.

Hmm I think they have to pay you for unapproved overtime.
But I'm pretty sure they can then fire you for it.
