So about three weeks ago I got hit while i was not moving at a stop sign. I took it in two supposidly reputable shops, got an estimate; told the kid. the kid / his parents didnt want to file a claim b/c his rates were already hella high, and i thought i'd be nice and not fiel (it wasnt my fault at all bc i wasnt moving), and he gave me a check for the amount of the estimates. I ordered new bumper and headlights.
so I removed all the pieces tonight, and was starting to put all the new ones on. I get the left headlight on, try to put the right headlight on, but it wont fit, I fist thougth it was a bad light, then i took a closer look and my fucking frame is bent and the only reason the other headlight was still in the correct position was becuase it was all cracked to hell on the bottom. but both the shops that did the estimate didn't even notice the headlight / frame deal, so when he paid me I didnt take that in to accountnow... becuase I settled with him already, and he's not an insurance company he doesnt have to pay me anymore $$$.
Do i have any recourse on this, or do I just get majorly fucked and have to eat the cost of getting my frame fixed etc..?

Was there a police report? Get it back to the shop, have a new est made and tell him you will have to file it if this also isn't paid for. Maybe you will get lucky.

Show the parents what was found after teardown, they should pay for it, they may change their minds and claim it on the insurance. You still have rights to have the damage repaired.

You have the report so you still hold the powa. Make them pay or file it and get it the right way.

The other party could legally argue the money paid to you was a "settlement".

Very true, if they have a reciept and something legal and binding stating any funds paid to him where for that.

It shouldn't cost too much to have the frame straightened. Find out how much it will be. When I got t-boned last year, the frame straightening cost me $350. The right side was caved in pretty bad too. Like was suggested before, have the parents come over and take a look at it. If they want to say they won't pay, then you can contact your insurance agent.

As long as you didn't sign anything that said that was the end of it you can still go after it. If they don't pay you can always submit it to their insurance.

Since MN is a "NO FAULT" state, when you get in an accident, you report to your insurance company. You have a legal binding agreement with your insurance company. Give them the police report, file a claim, pay your deductable, and your insurance has the responsibility to file suit against his. He'd be double fucked if your insurance goes after him, because he failed to report an accident to his insurance, so if his insurance has to find out 3rd person, he'll proly be cancelled. If it's not enough to claim (lower than deductable) just use the threat of claim to scare em' into payin ya... Legally, they owe nothing to you, but you have the insurance company on your side...
