There was a big debate on swerving to avoid deer and some insurance companies even state in their contracts that if you swerve to miss a deer and still smash up your car then you will not be covered. Dont really know how they would be able to tell unless they went to the scene but it is definatly not a good idea to swerve for deer.
Couple of years ago a guy that I went to school with was driving down the road with his mom and the swerved to miss some birds and ended up getting into a big accident and killing his mother. Just for birds. That would kinda suck to live with for the rest of your life.
