Well I got pulled over for my car being to loud tonight...and got a ticket for it what should I do cause I got a ticket for not having a muffler? is this a moving violation or what? should i just pay and forget or go to my court date and pled not guilty and show them i have a muffler on it?

SuperSleeper 04-15-2004 01:14 AM

I dunno. But I saw a guy in AV tonight w/ a heavily modded WRX that got pulled over for the same thing. I've never liked noise restrictions--they don't apply to motorcycles which defeats the whole purpose--they're the loudest things on the road.

Actually they apply to all motor vehicles, including motorcycles. It is illegal to modify the stock exhaust system in any way that creates any sharp crackling or popping noises. As far as I know, the state of MN doesn't have an exact decible limit, it is up to the officer's discretion.

santa 04-15-2004 01:23 AM

how much would you think this would be if i payed it? any idea I cant find anywhere that states anything about it? I'm just wondering how much i might need to set aside? and is it a moving violation?

AJ 04-15-2004 01:32 AM

I don't think it's a moving violation since it's directly for equipment.. You sure it's just nto a fix it ticket? If it is then you just put a stock system on and bring it in and it will be dropped.

santa 04-15-2004 01:37 AM

the cop said that i could go to my court date and pled guilty and pay it or not..? wtf?...anyone got some stock exhuast laying around i can borrow for a day? :) I have a muffler arriving here friday...unfortunatly 2 days to late.... :(

I see... but I guess what frustrates me is that a stock Harley exhaust is louder than just about any 3" Turboback exhaust on a DSM...

I know there are tickets for this w/ pricetags on em--I want to say they're around $80.
I'd try and fight it, especially if "too loud" is determined by the officer, and not a set decibel. :goodluck:

santa 04-15-2004 01:41 AM

thanks. and yes it is to loud for sure its annoying to me lol. thats why I bought the muffler and also am taking off the tubular manifold too and running a ported stock one....

tpunx99GSX 04-15-2004 01:48 AM

if the ticket directly say "no muffler" you can get out of it by showing that you have a muffler. a guy i knew got out of one of those even though he didnt have a muffler, it was in the trunk, he showed the judge that and they dropped the ticket

santa 04-15-2004 01:49 AM

thats what my plan of attack is right now I'll accually have it on my car though.

Kracka 04-15-2004 01:54 AM

Go to court and plead with the judge. Let him know there is now a muffler on your car and explain to him (make up a story) as to why you did not have one. Possibly something like it rusted off or someone stole it while you were at school, etc. It is an equipment violation so it will not affect your driving record or insurance. As Dane said, it is an $80 ticket.

santa 04-15-2004 01:57 AM

k so my $60 muffler is gonna save me $20 basically... cause i know that the prosuicuter(spelling?) is a coold guy and got me out of a $85 one The same cop tried to give me a year ago for a headlight being out on my old POS honda accord..1988 hehe I talked to him..had my mom with...didnt bring the car...and said it was fixed and hes like sounds good to me..bye

crackling or popping

SRT4 Stock crackles and pops more than most v8s I have seen around town.

Yeah my friends got tickets and they went to court. The first one put on a muffler-no fine. The second one got out of it because the cop had no decibel reader he just had us start our cars. (I was lucky with stock exhaust.)

Good Luck

SlowWhite 04-15-2004 03:03 PM

Ok, First off say it was a blown gasket. (the judge will have no idea what it really was and I doubt the officer will show up or have notes on this particularly small of a thing)

That way you don't need a BS repair write up. Tell them you fixed it yourself.

Play it off like it's a fix it ticket. And it'll get dropped. But make sure you start off saying that you were told to show it to someone. (ie: as if you thought you were suppsed to get it looked at. While you are at the Coart house) The judge will straight up look at you and ask is it fixed and he'll make a judgement based on your reply. So I do suggest you put your exhaust back on or fix the problem. that way when you reply you'll be honest.

I did this for 7 of my 8 no-front license plate tickets. The first one I didn't know it was a fix it ticket so I just paid (which by the way showed up on my driving report as a Minor Moving violation and does go against your insurance)

The others were dropped completely - no coart fee, no fine, no nothing. But the key to it is to be able to back up your bluff.

When you go make sure you have a full Exhaust. Not just a Downpipe attached.

That way if they descide they want to check (won't happen do to lazyness on there part) you can show them. Point out the gasket that was blown (ie: pick one) and say see I fixed it. - I doubt it'll go any farther then that. (if it even gets that far)

He is just trying to line up a bunch of grudge matches at MN Mayhem!! I will personally challenge him. If my car is so unreliable he won't have to worry because I won't make it to the other end of the track! :liar: :stupid:
