Can you sue someone......
 
Well I just bought a tubular manifold from dsmtrader and the buyer said that it was perfect condition with no cracks so I bought it and it turns out it is cracked. Can I sue him or can I not. I emailed him and he just won't reply my emails.

So my question is can I sue this HATER.

You could, but I don't think it's worth your time or effort. If he's not answering your emails, it's very obvious that he knows what's up. Just get it rewelded or buy another. You should inform others on the forum about the situation, so it doesn't happen to others.

File a claim with Ebay and or Paypal. You'll probably just get your money back from them.

Not if the scammer has any idea what hes doing. I got fucked for $315 for a catback, eBay and paypal couldnt do shit because he had taken the money from his paypal account and stopped using the accounts. You can call local police too, but I dont know which local police, his or yours. Google it up.

You can sue anyone for anything. Weather or not you'll win, or if it's worth your time and money is a different story. You got owned on the internet, it happens everyday. Your best bet would be to file a claim w/ whatever secondhand party you sent money through, and make a post on the forum he's on. Other than that, there isn't much to do, and more than likely your going to be SOL. I vote you pay a friendly visit to his house w/ a few buddies :D

If he isnt local I would just forget about it. You got ripped off, sucks but you would probably spend more trying to resolve it than the manifold is worth.

How did you pay for it? If you paid with paypal, and it's been less than 30 days, file a claim IMMEDIATELY! Act fast, or you will be out of luck.

If you paid with anything but cash I belive you can stop payment on anything within 36 hours. I have done this before with paypal. They get really mad,(as well as paypal) then I just ship the bad product back to them to be fair.

I filed less than two weeks after contact was broken and no luck. Just take it as a lesson learned and only deal with people you know and trust (or know where they live ;)).

Sorry to say that you would end up spending more money to try and take him to small claim's court like $500.00/w lawyer. The good thing is that you got the product from e-bay so you have the chance to stop payment and return too sender, I would Immedlitly file a bad buy report and the following action will insue paypal will refund money the seller will try and give you a negitive report on e-bay for not paying and you follow with a report with them saying they sell GARBAGE. In the long run Money will be returned too you as along as the 30days with paypal has'nt exceded, and chock it up as a lesson learned, and if you still are going to buy from E-GARBAGE buy from people you know or a repuitable sorce. If people would read the original post, he did not get the part from Ebay, it was off the DSMTrader. Hopefully he used Paypal, that is going to be the only way he might get something back. If you are on any national boards, some of those guys might do some vigilante justice because most people have been ripped off.

that is why I use my c.c. on paypal so if it is fucked up you can file with paypal and cancel the payment on you card. Or make them send it c.o.d. so you can check it out first

Ohhh Shit im stupid and didnt see that sorry, well is this DSMtrader like e-bay, I've never heard of this before.

If you used PayPal, I would put a file a dispute out there. I'm pretty sure it puts the other persons account on holding status where they can't do anything transactions via paypal until the claim is resolved. I did this for something I bought from Canada. Wasn't seeing my ordered product or money back so I filed the dispute. I saw my money back in no time because they were a place that heavily relies on paypal. That's what I'd do.
