WOW, that does suck, but at least it'll be covered. I wonder if his insurance will try to total it out?

I'd bet on it...it's pretty crazy what any meaningful repair costs these days.

Wow that sucks! But awesome they got his info!

What kind of charges can you file against him or what are the police doing becuase that seems like reckless endangerment or something?

I'm not sure when the police found him, but witnesses said he was pretty drunk and reeked like weed. So hopefully he'll get more than just a hit and run. As for the insurance fixing it or not, I'd hope they fix it, but if they don't, I'll just buy it back and find another 240 to put my parts and stuff into and part this one out.

Well the adjuster just looked at it, and said that purely due to it's age it's gonna be a total loss. He didn't have any numbers or anything for me yet, but the guy handling the claim is supposed to call me within the next day or two and let me know what the numbers are.

thats crazy kevin. Hope you get some decent money to be able to find another one. make sure you call your agent as well, he may be able to help get you the most out of the car. :)

Well it sounds like there's a $10k payout limit on his policy, and since he hit 3 vehicles that's going to be quickly reached. They said they may not be able to give me any more than $2500 for my car, even though NADA value, as well as local market value is right around $4500. As far as my own insurance, I have liability only, so I can't really get anything out of my policy. I provided the claims agent with two examples of similar cars, one selling for $4500, and the other selling for $6k (SR20 swapped) so hopefully I'll be able to get a little more out of it.

Does anyone know if I should just take him personally to small claims to get the full value? That, to me, seems like the most logical next step.

If all they're offering is $2500 for your car then it's probably time to get a layer. I've never heard of an insurance policy having a $10k limit...what if he hit a nicer/newer car? Sounds like BS to me. State minimum coverages are higher than that.

That's what I was thinking. I looked at the claim details online and it said there was a $25k limit, so I'm not sure where he's getting the $10k limit. Next time he calls I'm gonna have more questions.

Also you may what to look into whether its incident based or based on each car he hit. Ill shoot my brother a quick email and let you know what he says.

I think 30/60/10 is state minimum 10 be property damage. If you took him to court he would pay the rest out of pocket. That ends up being a pain in the ass though. Also I think they base they're payout on current market value not blue book.

Sounds like a messy night! Anyway, it doesn't sound to me as if Progressive is paying him based on value, but rather based on the fact that they have to split up the 10K among so many vehicles. If that is the case, he can attempt to sue the guy and retain the rest of the money. (that is why you should always carry more than $10k on your policy) If he is simply disputing Progressive's dollar value for he vehicle, he may be able to find some help with the Insurance Comissioners office. THey are part of the MN Dept of Commerce. You can file a complaint with them over the phone or online, I beleive.

If he has his own insurance, he should contact his agent. By filing a claim with his own company, there may be more that can be done to help him maximize his portion of the payout. It's always better to have the insurance companies negotiate amongst each other.

I'd go after the guy for the remainder, if nothing else the dude needs to be taught a lesson, maybe having to sell a few major possessions will teach him to act like an adult next time.

MN does have a 10k minimum limit for property damage, and that is split up between the 3 cars he hit. When the agent I was talking with gave me the $2500 number, he tried telling me that was the nada value, so I called him on it and provided him the two Craigslist postings. So currently I'm waiting on my copy of the police report and as soon as I have that, if they don't come up with a better offer, I'll be contacting a lawyer and see what my options are.

Well the insurance company came back with an offer of $3600 for my car with a little over $600 buyback offer. So I'll be buying the car back, and I have someone who wants to buy it for $1500 so I should be right about at my $4500 goal when all is said and done. Now I just have to find another car. I'm not entirely sure what I want, but I know it's going to be a manual trans, and RWD. I'd like to not have to take out a loan, but depending on what I can find I may have to.

also the buy back price is not concrete, try bump them down a bit on it, i got a few hundred off mine, buy back was 1,000 and i offered 600 and they took it. its always worth a shot, worst they can say is no!!
