So on December 26th, I was in an accident which totalled my car. The person I hit admitted fault completely. I went to the doctor the next day just to get checked out. I had injuries consistent with t-boning someone @ 55mph and it was nothing serious at all. I didn't miss work or any of that.

I got an offer for my car from the other person's insurance for pratically nothing. I can't replace my car at what they're offering.

Question is, do I sue now or what? Am I going to have to essentially barter with these assholes? I don't know what my options are here. I've called 2 lawyers and they say I'll have to request papers from Hennipen county and go to claims courts or something.

If anyone knows of something I can do and input is appreciated.

Haven't you gotten your insurance involved? They should be handling any sort of negotiations between yourself and the other person.

Yup, get your insurance involved and start the negotiations to get a fair value for your car.

1 800 AXE GARY!! Haha I would agree that you need to get your insurance involved, and maybe provide them with a couple examples of the market value of your car. The insurance companies always have to pay market value for your car, not book value.

Got it all figured out.

My insurance company couldn't battle it out for me since I only have liab on my car. I would have had to go to small claims court for full value of my car. I couldn't sue for injuries since I really didn't miss work at all, neither did my passenger, even though she sprained he back and neck.

Got a new car already anyway. Fuck insurance, fuck it all to hell. When I went to the Allstate office to get my check for my car I made it very clear how fucked I was in all this.

I hit some dumbass rich girl, and even though it's her fault 100%, she gets to go on with her happy life like nothing happened, and I get shit for my car and now I'm stuck with a fucking loan on a new one.

Awesome...

If you didn't know, when you call AXE GARY, its just a free service where they give you phone numbers for other lawyers. Gary doesn't do a fucking thing for you or anyone.

And people laugh at me for carrying full coverage on all my vehicles. THIS is the reason why I have full coverage, even on my 85 rusted MR2. It's money well spent when it comes down to having to fight with someone else's insurance company. Their insurance company is out to make money, just like yours is. They will do whatever they can to pay you the least that they can get away with.

I would definitely have yourself checked out for any injuries that might crop up from this later. Sometimes these things don't hit you until later on down the road. At least you will have a paper trail to prove that it was this incident that caused it. Whether you missed work or not, it shouldn't matter. An injury from this accident that becomes a chronic problem should be covered by the person that hit you.

Sounds like you're in a similar situation as me, only I haven't settled with his insurance yet.
